| Subscriber Agreements |
| All users of Network B data must sign an American Stock Exchange Subscriber Agreement prior to initiation of service. Separate agreements are available for Professionals and Non-Professionals.

| Pilot Program - Professional Per Query |
| Effective June 1, 2006, professional customers may pay for Tape B (Amex) data on a per query basis under a twelve-month pilot program. Professional subscribers must sign either the standard Professional Subscriber Agreement or Section 1 of the Usage-Based Services/Non-Professional Agreement.
Capping is not permitted for professionals.

| Professionals
|
| External vendors are required to submit completed Professional Subscriber Agreements to the Amex Market Data Services Department for approval prior to end-user entitlement. A response is guaranteed within 48 hours.
|
| For professional users, a completed Service Order is also required for all new locations. If a user's firm already has a Professional Subscriber Agreement on file with the Amex, only a Service Order should be submitted.

| Non-Professionals

A "non-professional" is defined as an individual person acting in his/her personal capacity and not:
- registered or qualified with the Securities and Exchange Commission, Commodities Futures Trading Commission, any state securities agency, securities exchange or association, or any commodities or futures contract market or association;
- engaged as an "investment advisor" as defined in Section 202(a)(11) of the Investment Advisers Act of 1940; or
- employed by a bank or other organization exempt from registration under federal and/or state securities laws to perform functions that would require registration or qualification if such functions were performed for an organization not so exempt.
