Reporting Requirements for Customers of Consolidated Tape Network B Market Data

A Market Data Customer who has executed the Agreement for the Receipt of Market Data (the "Agreement") and has been authorized by the American Stock Exchange to use Consolidated Tape and Consolidated Quote Network B (Amex) data received by means of distribution is required to report all installation, removal and relocation activity pursuant to Paragraph 11 of the Agreement.

Customers who use American Stock Exchange Network B market data for distribution to professional subscribers, such as in a trading room environment or local area network, are required to maintain and submit monthly reports to the American Stock Exchange (the "Exchange").

Such customers must receive prior approval from the Exchange before permissioning any professional subscriber. Approval for a professional subscriber must be given within 48 hours of notification from the customer the intent to install service. Upon approval from the Exchange, such customers must report all offices and devices that have been entitled to receive or otherwise have access to American Stock Exchange Network B market data for any time during the reporting period. A unit or its equivalent is defined as a CRT display, keyboard, individual password or terminal identifier, depending upon what is described in the Customer's Exhibit A. Professional subscribers are billed directly.

Customers who distribute uncontrolled datafeeds must receive prior approval from the American Stock Exchange for each datafeed. Approval requests can be submitted to the Exchange by going to www.Amexdata.com/exhibits. Requests for a userID and password for access to this site should be sent to amexmarketdata@amex.com. All uncontrolled datafeeds should be reported to the American Stock Exchange via the TCB Data website (www.tcbdata.com) using Solar or VARS, whichever is appropriate.

Customers who use Network B market data for distribution to non-professional subscribers are required to maintain monthly reporting to the Amex for its users. Customers should report number of users or number of quotes pulled for each calendar month. Reporting is performed via www.tcbdata.com; using the Usage link. Customers are billed directly for their usage-based and non-professional subscriber reporting.

Customers who use Network B market data for exclusive distribution to its employees are required to maintain and submit quarterly reports to the Exchange. The American Stock Exchange has developed an on-line reporting system for data feed customers at www.tcbdata.com/adfr. You will receive e-mail with instructions on how to report your users when it is time to send the first report.
