Data Policies for Network B
The American Stock Exchange serves as the administrator of CTA/CQ Network B. A copy of the CT and CQ plans can be found at www.nysedata.com/cta. Network B includes data for equities and ETFs listed on the Amex, as well as indexes calculated by the Amex. All distributors and users of Network B market data are required by contract to adhere to the Network B market data policies.

Network B Policy Descriptions

Network B Vendor Agreement Policy
Any party interested in becoming a Network B vendor must fill out a Network B Vendor Agreement and an Exhibit A before they will be authorized to receive the data. Please contact your vendor to initiate the data feed approval process. If you don't currently have a vendor, you may view a comprehensive list of vendors in the Market Data Vendors section of this site.

Subscriber Agreement Administration Policy
A subscriber agreement must be completed for all new users of Network B market data. To obtain a copy of the necessary contract, please refer to the Amex Agreements section of this site. The administration policy varies by type of user:
  • Professional Users — The professional subscriber agreement must be filled out by professional users and faxed to the American Stock Exchange. The agreement will be approved within 48 hours. Data may not be released to the end-user prior to approval.
  • Non-Professional Users — The non-professional subscriber agreement must be completed by all non-professional users. Executed agreements should be maintained on file by the vendor. See the Amex Agreements section of site for a definition of a non-professional user.

Service Order Policy
A service order must be completed and faxed to the American Stock Exchange any time a new professional service is installed or an administrative change to an account occurs. Administrative changes include, but are not limited to: customer name changes, relocations, vendor account number changes, or billing address changes. The service order will be approved within 48 hours. Data may not be released to the end-user prior to approval. Reporting Requirements Policy
A market data customer who has executed the Agreement for the Receipt of Market Data (the "Agreement") and has been authorized by the American Stock Exchange to use Network B data received by means of distribution is required to report all installation, removal, and relocation activity pursuant to Paragraph 11 of the Agreement. Real-Time Internal and External Data Vendors are required to report all installation, removal, and relocation activity on a monthly basis. Reports are due by the 20th of the month for the preceding month (e.g., the report for June activity should be received by the Amex no later than July 20th). Reporting may be submitted via Vendor Automated Reporting System (VARS). Questions about VARS should be directed to TCB Data Systems at www.tcbdata.com. Note: Vendors are not required to report users of delayed last sale data.

 

Pilot Program - Professional Per Query
On June 1, 2006, the Amex will begin a twelve-month pilot program that will allow Tape B professional customers to pay for data on a per query basis. During the twelve-month period, the Tape B per query price schedule will apply to professionals as well as non-professionals. The price schedule is as follows:

First 20 million quotes disseminated during a month $0.0075
Each of the next 20 million quotes $0.0050
Each additional quote disseminated during a month $0.0025

Please note, the practice of capping will not be allowed for professionals. All vendors and datafeed recipients are eligible to participate in the pilot program once they notify us of their intent to participate. Notification should be given in the form of a letter on company letterhead and signed by a corporate officer. The letter must indicate the date they plan to begin participating in the program and should be faxed to Amex Market Data at fax number 212 306 2086.

Amex Market Data Internal Use Policy for Vendors
Vendors are required to report all data entitlements used internally within their firm. All internal usage is fee liable with the exception of a limited number of devices used for technical support and product development. The fee-waiver for devices used for product development only applies if development charges are in place (see Product Development below). Sales support and demo devices are not eligible for a fee waiver. Device fees related to technical support and product development will be waived according to the following schedule:
For the first 500 active entitlements reported to the Amex, the vendor is permitted a maximum of 5% of that number for technical support and product development. After 500 entitlements, the percentage allowed is 2%. For non-professional users, a maximum of 10,000 non-professional entitlements can contribute to the number of active entitlements used in this calculation.

Product Development
Development charges of $200/month for bid/ask and $200/month for last sale will be assessed for in house use of real-time Amex data for product development.

Credit Policy
The credit policy is limited to one year. Customers may receive credit, if appropriate, for the prior twelve months.

Multiple Installation for Single Users (MISU) Credit Policy
A single device fee shall apply in respect of individual professional users receiving multiple services entitled for Network B real-time data. Vendors must contact Amex Market Data Services at 212-306-1340 or mdsacctmgmt@amex.com to discuss procedures for reporting, reconciliation, and verification. Emergency Facilities Policy
Network B does not impose charges on back-up facilities until they are activated; however, reports must be submitted for these facilities whether used or not. Once activated, fees will be charged for the back-up facilities.

Academic Waiver Policy
Fees for use of data by educational establishments are waived only on a case-by-case basis with prior permission of the Amex.

Display Requirement Policy
Amex display requirements pertain to delayed data only. The Amex requires a notice, stating that the data has been delayed by at least 20 minutes, to be prominently displayed on applicable screens and devices.
