Finally, the NASD Amex Regulation Division ("NASD") provides information as to the following surveillance "alerts" (i.e., trading activity that appears to be violative of a particular rule) to specialists on a monthly basis:

• ITS Locked/Crossed Markets - situations when a specialist "locks" or "cross-locks" the NBBO of another ITS participant without the issuance of an ITS commitment
• ITS Trade Through - situations when a specialist initiates the purchase or sale of an ITS eligible security on the Amex at a price inferior to the NBBO without the issuance of an ITS commitment
• ITS Executable Orders Unexecuted - situations where the specialist fails to execute an incoming ITS commitment at the displayed bid or offer
• ITS Pre-Opening - situations where the specialist fails to issue a pre-opening notification to ITS as required
• Options Firm Quote - situations where the specialist failed to give an order the price displayed upon receipt
• Options Executable Orders Unexecuted - situations where the specialist failed to execute and executable order
• Options Limit Order Display - failure to display a limit order that improves the ABBO on timely basis
• Options trading ahead - situations where the specialist trades ahead of a customer order
• Linkage Locked/Crossed Markets - situations when a specialist "locks" or "cross-locks" the NBBO of another linkage participant without sending a linkage order
• Linkage trade Through - situations when a specialist initiates an options purchase or sale on the Amex at a price inferior to the NBBO without the sending a linkage order
• Equities/ETF Freezes - situations where the specialist manually freezes the book and execution freezes of 20 seconds or greater
