AMERICAN STOCK EXCHANGE LISTS BANK OF AMERICA’S MINIMUM RETURN INDEX EAGLES LINKED TO THE DOW JONES INDUSTRIAL AVERAGE

New York, December 21, 2006 — The American Stock Exchange® (Amex®) today began trading Bank of America’s Minimum Return Index EAGLES Linked to the Dow Jones Industrial Average.

Priced at $1,000 with an initial offer size of $10,600,000, this bond trades under the ticker symbol BOR.T and has a maturity date of December 27, 2011.

The notes are issued by Bank of America. The Amex specialist unit is AGS/STR/OTA.
